TV psychologist "Dr. Phil" McGraw, whose Texas twang and folky common sense catapulted him to stardom, is being taken to court over his discontinued "Shape Up!" diet plan.

If all they want back is their money, they have a chance of getting class status. If they're saying there were physical damages as well, I'd be really surprised if they got class status.

Correct, I am currently working on keeping a few hundred malpractice suits against a doctor from going class action....different acts of malpractice, different injuries- how the heck could it be a class? Oh well, it pays.
